KEY DELIVERABLES
The Legal Officer: Legal Advisory is responsible for providing legal advisory services including legislative review and drafting. Manage legal research resources within the National Home Builders Registration Council (NHBRC).
The Individual will primarily be responsible for, but not limited to the following:
• Provide advisory service in the analysis and updating of current and internal policies and procedures;
• Participate in departmental and parliamentary processes relating to the new Housing Consumer Protection Act;
• Participate in meetings with drafters of the National Department of Human Settlements;
• Participate in the proclamation and gazetting of provisions of the current Housing Consumers Protection Measures Act 95 of 1998 or its substitutes;
• Draft notices of Gazetting for Rules, Regulations and Code of Conduct;
• Facilitate payment of relevant fees with Supply Chain Management;
• Responsible for the submission of notices to Government Printers;
• Ensure the safe keeping of legal documents;
• Provide input into Legal Advisory policies, procedures and process flows;
• Prepare and submit monthly and quarterly reports to the Manager;
• Respond to audit and risk queries;
• Implement audit and risk mitigating plans through the Corporate Services;
• Support the implementation of remedial actions in response to potential audit findings;
• Ensure adherence to all NHBRC policies, procedures and frameworks;
• Provide efficient legal advisory services to NHBRC staff as required in a cost-effective manner, reducing unnecessary litigation;
• Avoid unnecessary business travels;
• Manage tools of trade effectively to avoid premature depreciation;
• Report and act on any fraudulent activities timeously;
• Prepare training and awareness presentations on the Act, Regulations and other legislations as required by the business;
• Conduct training interventions as required by the business on the required content as above;
• Consult with internal and external stakeholders;
• Establish and maintain relations with key internal and external stakeholders to ensure support and cooperation relating to Legal Advisory;
• Attend and resolve queries within Legal Advisory division;
• Review instruction as received and study related documents;
• Consult with relevant parties to the instruction;
• Conduct research as required;
• Draft legal opinions and settle internally drafted opinions;
• Review externally drafted opinions and ensure instructions have been addressed adequately;
• Prepare submissions regarding conclusions reached and provide recommendations to clients/committee/division/stakeholder;
• Review section 22(3) applications received and consult with officials as required and request technical inputs into certain matters;
• Prepare memorandum for Internal Complaints Advisory Panel (ICAP);
• Prepare memorandum with recommendations from ICAP;
• Prepare letters in line with ICAP recommendations;
• Receive matters referred by the Public Protector and review related document files;
• Meet and consult with relevant officials including the Public Protector if required;
• Prepare response letters to Public Protector;
• Review Owner Builder draft letters;
• Attend Technical Evaluation Committee and provide legal inputs;
• Review Owner Builder submissions and EXCO resolutions;
• Settle draft letters in line with the EXCO resolutions.

MINIMUM REQUIREMENTS:
• Minimum LLB Degree is mandatory
• Admission as an Attorney or Advocate is an added advantage
• Minimum three (3) years Corporate Law experience

SYSTEM SKILLS:
• Microsoft Office
• SAP

APPOINTMENT
The above-mentioned position will be offered on a permanent basis with a Total Cost To Company package.
